Terms of Service

1. Agreement

By creating an account or using Karkaye (the “Service”) at karkaye.com, app.karkaye.com, or related apps, you agree to these Terms on behalf of yourself and, if applicable, the institute you represent. If you do not agree, do not use the Service.

2. The Service

Karkaye provides multi-tenant software for coaching institutes and schools — including student and batch management, attendance, fees, academics (exams, quizzes, assignments, materials), certificates, announcements, and related admin tools, via web dashboard and mobile applications. Features may evolve; we may add, change, or retire functionality with reasonable notice when material.

3. Accounts & eligibility

• You must provide accurate registration information and keep credentials secure.
• Institute owners are responsible for users they invite (staff, teachers, students, guardians) and for permissions they grant.
• You must be legally able to enter a contract and, where you enroll minors, authorized to process their data for school or coaching operations.

4. Acceptable use

You agree not to misuse the Service, including by: attempting to access other tenants’ data; reverse engineering except where law allows; sending spam or unlawful content via announcement channels; overloading infrastructure; or using the Service to violate student privacy or applicable education and data laws.

5. Your data

You retain rights to the content and records you submit (student rosters, marks, fees, messages, etc.). You grant us a limited license to host, process, and display that data solely to provide and secure the Service. Each institute’s data is isolated as described on our Security and Privacy pages. You are responsible for the lawfulness of data you upload and messages you send to parents and students.

6. Plans, free use & payment

You may start on a free plan subject to fair-use and capacity limits we publish or communicate (for example around institute size, sites, or messaging channels). Paid plans, if any, are agreed separately — often based on institute size, sites, and channels. Fees are non-refundable except where required by law or stated in a written order. We may suspend accounts for non-payment of agreed paid plans after notice.

7. Third-party services

The Service may integrate with third parties (payment providers, email/SMS/WhatsApp delivery, calendar providers, app stores). Those services have their own terms; we are not responsible for their outages or policies beyond our reasonable integration care.

8. Availability & support

We aim for reliable operation but do not guarantee uninterrupted access. Scheduled maintenance and emergency fixes may cause temporary downtime. Support channels and response expectations may differ between free and paid plans.

9. Intellectual property

Karkaye, its software, branding, and documentation remain our property (or our licensors’). These Terms do not sell you the software — they license access to the Service for your institute’s internal operations during an active account.

10. Disclaimer & liability

THE SERVICE IS PROVIDED “AS IS” TO THE MAXIMUM EXTENT PERMITTED BY LAW. WE DISCLAIM IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES, OR LOST PROFITS/DATA, ARISING FROM USE OF THE SERVICE. OUR AGGREGATE LIABILITY FOR CLAIMS RELATING TO THE SERVICE IS LIMITED TO THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE CLAIM (OR, IF YOU ONLY USED A FREE PLAN, TO A NOMINAL CAP OF USD 50).

11. Termination

You may stop using the Service and request account closure. We may suspend or terminate access for material breach, abuse, legal risk, or extended non-use of free accounts after notice where practical. Upon termination, your right to access the Service ends; we may delete or retain data as described in Privacy and as required by law. Export requests should be made before closure when possible.

12. Changes

We may update these Terms. Material changes will be indicated by updating the date above and, where appropriate, notice via the Service or email. Continued use after changes take effect constitutes acceptance.
